How to Register a Society for Apartment?
A society for an apartment may or may not be registered. Registration of a society for apartment is necessary as per the association of the apartment owners or else the occupants. The registration of such kind may be done either according to the Tamil Nadu Societies act, 1975 or else under the Tamil Nadu Co-operative Societies Act o 1983.
To register a society for apartment is a simple process actually. One of the formal requirements for registration is to fill and submit a memorandum which consists of name of the society, objects of the society, name, address and occupation of those members belonging to the committee. In addition to the above requirement, it is essential to file the byelaws. It is the byelaw that is meant for the current time either because of force of society or else of the association of owners of the apartment. This includes certain amendments to be made to these bylaws.
At certain times to register the society, the name of the society may be undesirable. Thus if there is any objection to this name, then that particular name has to be modified. Some prescribed forms and certain matters are included in both the memorandum as well as in the bylaws. Hence it very much advisable for you to get confirmed with the requirements.
After the formation of the society, the maximum time limit to register the society is three months. But there could also be certain situations which would take considerable period of time for registration. Certain measures can be taken at those situations with decisions made depends on the case-to-case basis. But it is advised to register those associations that are newly formed. For those societies which have been registered, it would be very easy to have the bank accounts and operations in banks can be easily performed.
